Terms of Service

1. Acceptance of Terms

By accessing or using the HopUp application and website (the "Service"), operated by HopUp ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be of legal drinking age in your jurisdiction to use HopUp (21 years of age or older in the United States, 18 or older in most other countries). By using the Service, you represent and warrant that you meet this age requirement. We reserve the right to request proof of age at any time and to terminate accounts that violate this requirement.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts at our discretion.

4. Acceptable Use

When using HopUp, you agree NOT to:

  • Promote excessive or irresponsible alcohol consumption
  • Post content that is illegal, harassing, threatening, defamatory, or otherwise objectionable
  • Impersonate another person or misrepresent your identity
  • Share another user's location or personal information without their consent
  • Use the Service for any commercial purpose without our written consent
  • Attempt to gain unauthorized access to other users' accounts or our systems
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Violate any applicable laws or regulations

5. User Content

5.1 Your Content

You retain ownership of content you post on HopUp (photos, check-ins, messages). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Service and for promotional purposes.

5.2 Content Moderation

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice. We are not obligated to monitor all user content but may do so at our discretion.

6. Location Services

HopUp uses location data to provide its core features. By enabling location services, you understand that:

  • Your location will be shared with your approved friends when you check in
  • Check-in locations are displayed on a live map visible to your friends
  • You can disable location sharing at any time through your device or app settings
  • Location data is processed in accordance with our Privacy Policy

7. Responsible Drinking

HopUp is a social platform that connects friends. We strongly encourage responsible alcohol consumption. The Service is not intended to encourage excessive drinking. Please:

  • Drink responsibly and know your limits
  • Never drink and drive — use rideshare services or designated drivers
  • Look out for your friends and their safety

8. Intellectual Property

The Service, including its design, logos, trademarks, and all content created by us, is our intellectual property and is protected by copyright and trademark laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

9. Third-Party Services

The Service may contain links to or integrations with third-party services (e.g., maps, venue data, payment providers). We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR THE ACCURACY OF USER-GENERATED CONTENT, INCLUDING VENUE INFORMATION AND CHECK-IN DATA.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOPUP AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless HopUp and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from these Terms shall be resolved in the courts of Germany, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
